Emeka (not real name ) is suspected to have committed an offence but he was no where to be found so they arrested his mother, not because she did anything wrong. Not because she was a suspect. But because they believed if she suffered long enough, Emeka would show up.
It sounds like something that “just happens” in Nigeria, right? But here’s what many people don’t know ;that act is ILLEGAL .
This practice is called ARREST IN LIEU and the law is very clear about it. The police cannot arrest your mother, your wife, your brother, or anyone connected to you just to force you out. It doesn’t matter who gave the order or how serious the allegation is.
Section 7 of the Administration of Criminal Justice Act (ACJA) 2015 expressly prohibits it. In simple terms, you cannot punish one person for another person’s alleged offence.
So if you ever find yourself in that situation, don’t just panic. Ask the right question: “What offence has this person committed?” If there’s no clear answer, that’s a serious red flag. Then start documenting everything names, badge numbers, the station, the time, and any witnesses.
Most importantly, don’t stay silent. Reach out to a lawyer or organisations like SERAP,, or Legal Aid . You can also report to the Police Service Commission or take legal action.
No innocent person should be used as bait. Not under any system. Not under any excuse.
